FIANZA DE CUMPLIMIENTO
Es la garantía de cumplimiento de contrato, emitida por una afianzadora autorizada, que el licitante ganador deberá entregar al beneficiario en los días posteriores a la formalización del contrato. Garantiza la entrega oportuna y puntual, con las características y en las cantidades estipuladas, de los bienes o servicios contratados. El monto afianzado puede variar y generalmente oscila entre el 5% y el 100% del valor contractual. La fianza se hará exigible cuando el tomador incumpla cualquiera de sus obligaciones contractuales por causas a él imputables, y normalmente la aplicación de la garantía de cumplimiento será proporcional al monto de las obligaciones incumplidas más multas/sanciones, si están cubiertas.
PERFORMANCE BOND
Bond guaranteeing the performance of a contract, issued by an authorized surety, to be submitted by the tender winner to the beneficiary, following contract execution. It guarantees the punctual delivery of goods and services in the amounts and with the characteristics stipulated in the contract. The bond amount may usually range from 5% to 100% of the contract price. The bond is enforceable when the principal fails to perform any contractual obligation due to causes attributable to him and is normally claimed for a proportional amount of the unfulfilled obligations plus fines/penalties, if they are covered.
